In this document, we explain the terms and conditions that apply to orders placed through https://motivelab.it. We advise you to read the document carefully.

2. Products covered

These Terms apply to products sold by Motivelab, including:

• standard or customised stickers for automotive, cosmetic, decorative or sporting use;
• aftermarket car parts made from fibreglass, carbon fibre, ABS or other materials, including spoilers, side skirts, covers and similar accessories.

The products may be intended for cosmetic, personal, sporting, collectable or competitive use, unless otherwise expressly stated in the product description.

Suitability for use on public roads, any type-approval, compatibility with the vehicle and compliance with local regulations remain the sole responsibility of the purchaser, who must verify these before purchase and installation.

3. Prices and payments

All prices are quoted in euros (€) and include applicable taxes, where due and where indicated at the checkout stage.

We accept payment via PayPal and credit/debit cards via Stripe.

The order is only considered confirmed once payment has been successfully processed.

For shipments outside the EU, any duties, VAT/import tax, customs charges, clearance costs or fees required by the country of destination are to be borne exclusively by the recipient. Motivelab is not liable for any delays, hold-ups or costs arising from customs checks.

4. Estimated production times

Production and preparation times are indicative and do not constitute a strict deadline, unless otherwise agreed in writing.

Approximate times:

• standard or customised stickers: 9-10 working days upon payment and, where applicable, upon approval of the file/graphic;
• Car parts in stock: 3–4 working days;
• car parts currently being restocked or in production: 20–30 working days, unless otherwise notified.

Any delays caused by suppliers, production, customisation, couriers, unavailability of materials or other reasons beyond Motivelab’s control do not entitle the customer to automatic cancellations, compensation or damages, without prejudice to the consumer’s mandatory rights.

5. Dispatch and delivery

Deliveries are made via a tracked express courier service.

Estimated times:

• Italy and the European Union: as a rough guide 48 hoursup to 3–4 working days for remote areas, islands or disadvantaged localities;
• Non-EU countries: as a guide 5-10 working days, subject to customs checks or delays on the part of the carrier.

Delivery charges are calculated at checkout. There is no automatic free delivery threshold, except where promotions are specifically stated.

The tracking details are sent to the customer when the parcel is handed over to the courier.

From the moment the goods are handed over to the carrier, any delays in delivery not attributable to Motivelab shall not give rise to any liability for damages, compensation or loss of use of the product.

6. Right of withdrawal

The right of withdrawal applies only to consumer customers, in the cases and within the limits set out in current legislation.

The consumer may exercise their right of withdrawal within 14 days from the date of delivery, by sending written notification by email.

The right of withdrawal does not apply to products that are made to measure, clearly personalised, manufactured at the customer’s request, modified, cut, painted, adapted or otherwise unsuitable for resale as a standard product.

Return policy for standard products:

• car parts: undamaged, unassembled, unpainted, unmodified, and in their original packaging;
• stickers: protective liner intact; film not applied, not cut, not damaged and not removed from the backing.

The customer must return the product within 14 days from the notice of withdrawal. The costs and liability for the return delivery shall be borne by the customer, unless otherwise required by law.

Motivelab may withhold the refund until it has received the goods or until proof of return dispatch has been provided. The refund will be processed once the product has been checked to ensure it is in good condition, using the same payment method where possible.

The customer is liable for any reduction in the value of the goods caused by handling, assembly, testing, damage or use that is not necessary to verify their nature and characteristics.

7. Statutory guarantee of conformity

For consumer customers, the statutory guarantee of conformity provided for under Italian and European legislation applies, with a duration of 24 months from delivery. The time limit for bringing a claim in respect of defects that have not been fraudulently concealed is governed by the statutory time limits.

The warranty covers only any lack of conformity existing at the time of delivery and does not cover damage resulting from misuse, incorrect installation, modifications, painting, impact, wear and tear, improper maintenance or use not in accordance with the instructions.

Where a lack of conformity is established, the consumer is entitled to the remedies provided for by law, including repair, replacement, a price reduction or termination of the contract where permitted.

For business customers, companies, VAT-registered individuals or purchases made for professional or commercial purposes, the provisions of the Civil Code apply. The purchaser must report any defects within 8 days since the discovery and the right of action is time-barred within 1 year from delivery, unless otherwise provided for by law with a mandatory time limit.

The warranty does not cover products that have been installed, modified, painted, cut, adapted or used in an unauthorised manner prior to the defect being reported, unless it can be demonstrated that the defect was present from the outset and is not attributable to such actions.

8. Limitations and exclusions of liability

To the fullest extent permitted by applicable law, Motivelab’s liability is limited solely to the purchase price of the goods actually paid by the customer.

No compensation, reimbursement or damages shall be payable in respect of labour costs, installation, removal, painting, vehicle downtime, loss of use of the vehicle, loss of profits, loss of business opportunities, indirect or consequential damages, or any further expenses incurred by the customer.

Defects, damage or malfunctions arising from the following are excluded from the warranty and from any liability:

• misuse of the product;
• installation that does not comply with the instructions provided or that is carried out by unqualified personnel;
• painting, drilling, cutting, alterations, modifications or other work not authorised in writing by Motivelab;
• incorrect preparation of the application surface;
• the use of solvents, harsh detergents or unsuitable chemicals;
• high-pressure washing carried out at an excessively close distance;
• prolonged exposure to chemicals, fuels, oils, the elements or extreme environmental conditions;
• temperatures above 95 °C or below -40 °C;
• UV rays, heat, humidity or conditions of use that exceed the material’s normal specifications;
• normal wear and tear, scratches, discolouration, minor cosmetic flaws, slight colour variations between production batches, or differences between the on-screen preview and the final result.

The performance of adhesives and adhesive products depends on the correct preparation of the substrate and compliance with application parameters, including temperature, humidity, pressure, surface cleanliness and substrate compatibility. Any delamination, lifting, bubbling, sagging or defects resulting from a contaminated substrate, incompatible paints, waxes, silicones, polishes, surface treatments or applications outside the specified range are not covered by the warranty.

The customer confirms that they are aware that the products purchased may be intended for aesthetic, collectable, sporting, competitive or off-road use, unless otherwise expressly stated in writing on the product description page.

Before making a purchase, the customer is required to check for themselves the legislation in force in their state, country, region or territory of use, including any requirements relating to type-approval, authorisation, testing, updating of the vehicle registration document, certification or compliance with applicable road traffic regulations.

It is the customer’s sole responsibility to ensure, prior to purchase and installation, that the product complies with the laws, regulations and provisions in force in the country where the product will be used. Motivelab does not guarantee that the product is type-approved, approved or freely usable on public roads, unless expressly stated in writing.

Any reference to “competitive use”, “sporting use”, “aesthetic use” or similar indicates that the product may not be type-approved for use on public roads. Motivelab accepts no liability in the event of checks, fines, charges, administrative impoundment, special roadworthiness tests, failure to pass a roadworthiness test, compulsory removal or any other consequences arising from the use of the product.

The customer is solely responsible for the use, installation and operation of the vehicle fitted with the products purchased, as well as for complying with the instructions provided and the regulations in force.

The seller shall not be liable for any direct or indirect damage arising from the use, installation or incorrect application of the products purchased.

Under no circumstances shall these limitations and exclusions limit, exclude or curtail the mandatory rights granted to consumers under applicable Italian and European legislation.

9. Transport damage

The customer is required to check that the packaging and goods are in good condition upon delivery.

If the packaging is damaged, tampered with, wet, crushed, opened or otherwise not intact, the customer must only accept the consignment if specific written reservation, clearly stating the nature of the damage found. The generic phrase “subject to reservation” is not sufficient.

Any visible damage must be reported to Motivelab within 48 hours from delivery, attaching photographs of the outer packaging, the dispatch label, the contents and the damage observed.

In the absence of a specific reservation or prompt photographic evidence, Motivelab may not be able to open or process the insurance claim with the carrier and cannot be held liable for the carrier’s rejection of the claim.

This is without prejudice to the mandatory rights granted to consumers under the applicable legislation.

10. Dispute resolution

For consumer customers, the competent court is that of the consumer’s place of residence or domicile, where provided for by the applicable legislation.

For professional clients, companies, VAT-registered individuals or persons making purchases for purposes relating to their professional or commercial activities, the exclusive place of jurisdiction shall be Parma, unless otherwise agreed in writing between the parties.

Motivelab is not obliged to participate in alternative dispute resolution procedures, except where there are mandatory requirements under the applicable law.

11. Protection of personal data

The personal data provided by the customer is processed solely for purposes relating to order management, dispatch, invoicing, accounting and tax compliance, after-sales support and the handling of any complaints or warranty claims.

Data processing is carried out in accordance with EU Regulation 2016/679 and the applicable data protection legislation.

12. Force majeure

Motivelab shall not be liable for any delays, suspensions or failure to produce, deliver or fulfil its obligations arising from causes beyond its control.

Examples of force majeure include, but are not limited to: natural disasters, fires, floods, pandemics, epidemics, wars, acts of terrorism, strikes, customs blockades, measures taken by the authorities, transport disruptions, power cuts, IT failures, unavailability of raw materials, and delays on the part of suppliers or carriers.

In such cases, Motivelab may suspend, postpone or cancel the fulfilment of the order, without this giving rise to any liability for consequential damages, loss of profits or further compensation.

13. Governing law

This contract is governed by Italian law and applicable European legislation, to the extent that such legislation is mandatory.

Consumers remain entitled to the mandatory protections provided for by the law of their country of residence, where applicable.

14. Changes to the Terms

Motivelab reserves the right to amend, update or supplement these Terms at any time.

For each order, the version of the Terms published on the website at the time of purchase shall prevail.

Any subsequent changes shall not apply retrospectively to orders that have already been finalised, unless otherwise required by law.
